A Better Balance and Transgender Law Center Launch Know-Your-Rights Guides for Transgender and Non-Binary Workers

Critical workplace laws can support the health, well-being, and financial security of trans and non-binary employees.

As we witness the rise in workplace discrimination and increased barriers to employment, Transgender Law Center and A Better Balance have partnered together to release new resources to support trans and non-binary employees with the critical information they need to exercise their rights at work to leave and accommodations. Ensuring that trans and non-binary employees can navigate the workplace is crucial to creating a safe, inclusive, and well-informed working environment.

Know Your Rights Guides for Transgender and Non-Binary Workers

When employees are able to show up as their authentic selves, without fear of discrimination for taking the time they need to address many of life’s defining moments. Strong workplace protections are essential to ensuring transgender and non-binary employees have the support, time, and flexibility to take care of themselves and their loved ones. These types of policies promote equity and allow for all employees to thrive. 

These guides aim to inform transgender and non-binary workers about their rights under: (1) the federal Family & Medical Leave Act (FMLA); (2) the numerous existing state paid family & medical leave programs; and (3) the federal Pregnant Workers Fairness Act and PUMP Act.

The resources outline how these laws can provide support during common scenarios that transgender and non-binary individuals may experience as they care for themselves and the people they love.

“Every employee, regardless of their gender, deserves the same rights and accommodations as their peers,” said Molly Dillon, Helpdesk Coordinator at Transgender Law Center. “No one should have to decide between financial stability and getting the care they need. Inclusive leave policies support the growing needs of transgender and non-binary employees and ensure that all employees have the freedom to prioritize their health and receive the care they deserve.” 

“For trans and non-binary pregnant workers, accessing reliable, accurate, and affirming information about leave options, pregnancy accommodations, and the right to pump at work can be difficult to impossible,” said Jesse Workman, Senior Staff Attorney at A Better Balance. “In this current political climate especially, where transgender and non-binary people are facing increased hostility, it is especially important to equip workers with vital information about their rights to take care of themselves and the people they love.”
